Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of being permitted to enter the property and to participate in ranch activities — including but not limited to horseback riding and other farm animal activities, hiking, fishing, hunting, use of trails, vehicles, and equipment, and attendance at events (the "Activities") — I, the undersigned participant, on behalf of myself and any minor children listed below, agree as follows:
Assumption of Risk
I understand that the Activities are inherently dangerous and involve risks of serious bodily injury, death, and property damage, including risks arising from the unpredictable behavior of animals, terrain and weather conditions, the condition and use of equipment and vehicles, and the actions of other participants. I voluntarily assume all such risks, both known and unknown, including the inherent risks of farm animal activities described in Chapter 87 of the Texas Civil Practice and Remedies Code.
Release and Waiver
To the fullest extent permitted by law, I release, waive, and discharge the ranch, its owners, lessees, employees, agents, and family members (the "Released Parties") from any and all claims, demands, and causes of action, including those arising from the ordinary negligence of the Released Parties, for any injury, death, or property damage arising out of or related to my participation in the Activities. This release does not extend to gross negligence, or willful, wanton, or intentional misconduct.
Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, and expenses (including reasonable attorney's fees) arising out of or related to my participation in the Activities, or the participation of any minor on whose behalf I sign, whether brought by me, the minor, or a third party.
Medical Authorization
I authorize the Released Parties to obtain emergency medical treatment for me or for any minor listed below if needed, at my expense.
Miscellaneous
This agreement is governed by the laws of the State of Texas. If any provision is held unenforceable, the remaining provisions remain in full force. I acknowledge that I have read this document, understand it, and sign it voluntarily. I agree that an electronic signature has the same force and effect as an original signature.
